Terms of Service

By downloading, installing, accessing, or using the Dategent desktop application or the Dategent website (together, the “Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

Dategent is software that signs in to your own Instagram account and, on your behalf, follows accounts, sends and replies to direct messages, optimizes your profile, and helps you discover and evaluate other Instagram users as dating prospects. Some functions run locally on your device (including your Instagram login session). Other functions run on our servers — including storing the content of the messages your agent sends and receives, generating message drafts via AI providers, and (when enabled) building a pool of prospect profiles. Our Privacy Policy describes exactly what is processed where.

You must be at least eighteen (18) years of age to use Dategent. Dategent is strictly prohibited for any person under 18. By using the Service, you represent that you are of legal age to form a binding contract and meet all eligibility requirements stated herein.

You connect and operate your own Instagram account through Dategent, and you are solely responsible for that account and for all activity Dategent performs on your behalf. Automating activity on Instagram may violate Instagram's Terms of Use and may result in your account being rate-limited, action-blocked, restricted, or permanently banned by Meta. You accept that risk. You are responsible for ensuring your use of Dategent complies with Instagram's terms and all applicable laws.

You agree not to use Dategent to (a) send messages to any person known or reasonably believed to be under 18; (b) harass, stalk, threaten, or abuse any person; (c) send spam, mass unsolicited messages, or commercial solicitation; (d) impersonate any person or entity; or (e) use the Service for any unlawful purpose. You are solely responsible for the content of any message generated or sent from your account.

Subject to your compliance with these Terms and payment of applicable fees, Dategent grants you a non-exclusive, non-transferable, revocable, limited license to download, install, and use the Dategent desktop application on computer(s) you own or control, solely for your personal, non-commercial use.

Dategent processes public profile information about other Instagram users to assemble dating prospects, and runs automated AI safety checks intended to exclude minors and the wrong gender. You acknowledge and agree that these safety filters reduce but cannot perfectly prevent messaging the wrong person (including minors), that you will independently exercise judgment before any real-world contact, and that you will report any safety concern to support@dategent.io. This mirrors the acknowledgment you make at checkout.

Dategent is offered on a monthly subscription basis at either $49/month (Starter) or $99/month (Pro). Subscriptions auto-renew each month until you cancel. You may cancel at any time via the Whop billing page (Settings, Manage Billing); cancellation stops future charges but does not refund past charges and takes effect by ending your paid access and benefits. NO REFUNDS: Dategent is a gradual system and meaningful results take two to four weeks to appear. We do not offer refunds, including for dissatisfaction, account issues, or unmet expectations. We reserve the right, at our sole discretion, to suspend or terminate any account for any violation of these Terms — in particular any attempt to bypass age verification, message minors, or harass others. You may terminate your account at any time using the Delete account option in Settings. Suspension or termination for a policy violation does not entitle you to a refund.

Dategent is provided “AS IS” and “AS AVAILABLE” without warranty of any kind, express or implied. We do not guarantee dates, reply rates, account safety, uninterrupted service, or any specific outcome. Use of automation on Instagram may result in your account being action-blocked, restricted, or banned by Meta. You assume full responsibility for these risks. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DATEGENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF INSTAGRAM ACCOUNT, LOSS OF DATA, LOSS OF RELATIONSHIPS, EMOTIONAL DISTRESS, OR MISSED OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID DATEGENT IN THE THREE MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless Dategent and its officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right, including any privacy right of the Instagram users you contact.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Delaware.

We may modify these Terms at any time. We will notify users of material changes by email or in-app. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
